Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Billing Cycle (also referred as "billing period") refers to the monthly period for which service fees are assessed.

  • Pro-Rated Billing refers to a method of calculating service fees based on the portion of the billing cycle during which the service was used

  • Service provider (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Proactive isp (Pty) Ltd, registration 2024/276512/07 and our Partners.

This document outlines the payment terms for services offered by Proactive ISP ("we" or "us") and you, the "Customer." A copy of the full service agreement can be found on our website.

Service Fees

  • You agree to pay the fees for the services you select, including internet plans, website hosting packages, and any applicable taxes and surcharges. Specific fees are detailed in your service agreement or on our website.

  • We reserve the right to adjust service fees with reasonable notice. We will notify you of any price changes through your preferred communication method (e.g., email, website announcement).

Billing Cycle

We offer two billing cycle options:

  • Standard Monthly Billing: Applies to most plans. You will be billed the full monthly service fee at the beginning of each billing cycle.

  • Pro-Rated Monthly Billing: Applies to specific plans as identified in your agreement or website. With pro-rated billing, you are charged only for the portion of service used during your initial billing period. For example, activating a pro-rated plan on the 15th of the month incurs a charge for the remaining half of that month's service fees. Subsequent billing cycles follow the standard monthly cycle. Your billing statement will clearly outline the pro-rated amount and the full monthly rate for following cycles.

Payment Methods

We accept the following secure payment methods:

  • Credit Card (Visa, Mastercard, etc.)

  • Debit Card

  • You can set up automatic payments through your online account.

    Late Payments

    • A late payment fee of 15% will be applied to any outstanding balance remaining unpaid after the due date and the grace period.

    • We may report late or unpaid balances to credit bureaus, which could negatively impact your credit score.

    • We reserve the right to suspend any or all services for past-due payments. A service reconnection fee may apply in such cases.

    • We may also pursue legal action to collect any outstanding debts.

    Termination

    In the event of service termination by either party, any outstanding balance must be paid in full.

    • We may require a 1-month written notice before terminating your service. Pro-rated charges will apply for your final service period, if applicable based on your chosen plan.

    • You can conveniently initiate service cancellation through your online account.

    Additional Charges

    You are responsible for any additional charges incurred during your service, such as:

    • Exceeding data usage limits

    • Exceeding website storage quotas

    • Equipment rentals

    • One-time setup fees

    We will notify you via email if you are approaching or have exceeded your data usage limit or website storage quota.

    Data Usage and Website Storage

    • Data Usage: Some internet plans have data usage limits. If you exceed your data usage limit, you may incur additional charges or experience throttling (a temporary slowdown of your internet speed). We will notify you via email if you are approaching or have exceeded your data usage limit. Details on data usage limits, throttling practices, and associated charges can be found in your service agreement or on our website.

    • Website Storage: Website hosting plans have storage quotas for your website content. If you exceed your website storage quota, you may be contacted to upgrade your plan or delete unnecessary files. Details on website storage quotas and upgrade options can be found in your service agreement or on our website.

    Disputes

    If you have any questions or disputes regarding your bill, please contact our customer service department within 5 working days of receiving your statement. We will work with you to resolve the issue in a timely manner. If the dispute cannot be resolved through customer service, you may have the right to file a formal complaint with [relevant regulatory body, e.g., Federal Communications Commission (FCC) for internet service].

    Changes to Payment Terms

    We reserve the right to modify these payment terms at any time. We will provide notice of any changes through our website or email.
